In the case of CENTILLION DATA SYSTEMS, LLC v. QWEST COMMUNICATIONS INTERNATIONAL, INC. et al. the Court of Appeals for the Federal Circuit addressed the issue of infringement for “use” of a system claim that includes elements in the possession of more than one actor. In this case Centillion appealed the district court’s grant of summary judgement that Qwest did not infringe the claims of US Patent No. 5,287,270 (‘270 patent). The ’270 patent discloses a system for collecting, processing, and delivering information from a service provider, such as a telephone company, to a customer.
