Patent Reviews

Typically only a small portion of any portfolio will actually have potential for monetization. Identifying these patents can be a very daunting task. However, once the portfolio is characterized and understood, the portfolio becomes much more manageable and monetization becomes possible.

GIS helps clients to mine and understand their portfolio to aid in their portfolio management activities. Common uses of patent reviews are;

  1. Determining the applicability of the patent to industry,
  2. Determining the market value of the patent for divestiture or acquisition.

GIS’ patent reviews take into account many considerations including;

  • The potential commercial use of the invention,
  • The ability to show evidence of use with reverse engineering techniques,
  • Identifying strengths and limitations of the claims, and
  • Identifying possible related art or invalidity issues.
  • Although every case is different, depending on the client’s goals and budget, our patent reviews typically take on a combination of one or more of three different forms:

 

Quick Review
Quick Reviews are typically used during Patent Mining to triage a large portfolio to identify the most promising patents. The key is to quickly eliminate the less promising patents so more time can be spent analyzing those that have the most promise.

Preliminary Review
A Preliminary Review is typically performed in relation to due diligence for acquisition or with a specific licensing activity in mind. The review provides a concise document that combines patent claim information together with specific evidence of commercial use to allow clients to decide if further analysis is warranted or if enough information is provided to proceed with the acquisition or licensing activity.

Detailed Review
A Detailed review provides clients, who want a more in depth look at their patents, information which characterizes the patent(s). Since this review is not targeted to any specific licensing activity, the results are expected to be reused over time as a living document. The detailed review covers a wide number of categories that will allow a client to not only use the information for current IP management activities, but to revisit and revise over time. Most clients will maintain this information in their own patent database. GIS can provide the data in a format to allow the client to import information into their database.
